Cauza C-646\/21 &#8211; Staatssecretaris van Justitie en Veiligheid (Femei care se identific\u0103 cu valoarea egalit\u0103\u021bii \u00eentre sexe)"},"content":{"rendered":"<p>Conform unui comunicat de pres\u0103 publicat la data de 11 iunie 2024 pe pagina oficial\u0103 de internet, Curtea de Justi\u021bie a Uniunii Europene (CJUE) a statuat, \u00een <a href=\"https:\/\/curia.europa.eu\/juris\/documents.jsf?num=C-646\/21\" target=\"_blank\" rel=\"noopener\">cauza C-646\/21 &#8211; Staatssecretaris van Justitie en Veiligheid<\/a> c\u0103, femeile, inclusiv cele minore, care \u00eemp\u0103rt\u0103\u0219esc ca o caracteristic\u0103 comun\u0103 identificarea efectiv\u0103 cu valoarea fundamental\u0103 a egalit\u0103\u021bii \u00eentre femei \u0219i b\u0103rba\u021bi, intervenit\u0103 \u00een cursul \u0219ederii lor \u00eentr-un stat membru, pot, \u00een func\u021bie de condi\u021biile existente \u00een \u021bara de origine, s\u0103 fie considerate ca apar\u021bin\u00e2nd unui \u201eanumit grup social\u201d ca \u201emotiv de persecu\u021bie\u201d care poate conduce la recunoa\u0219terea statutului de refugiat.<\/p>\n<p>Dou\u0103 adolescente irakiene locuiesc f\u0103r\u0103 \u00eentrerupere din 2015 \u00een \u021a\u0103rile de Jos. \u00cen urma respingerii cererilor lor ini\u021biale de protec\u021bie interna\u021bional\u0103, acestea au introdus cereri ulterioare. Ele au ar\u0103tat \u00een sus\u021binerea acestor cereri c\u0103, \u00een urma \u0219ederii lor \u00eendelungate \u00een \u021a\u0103rile de Jos, au adoptat normele, valorile \u0219i comportamentele tinerilor de v\u00e2rsta lor din aceast\u0103 societate. \u00cen cazul \u00eentoarcerii \u00een Irak, acestea consider\u0103 c\u0103 sunt incapabile s\u0103 se conformeze normelor unei societ\u0103\u021bi care nu acord\u0103 femeilor \u0219i fetelor acelea\u0219i drepturi ca cele de care dispun b\u0103rba\u021bii \u0219i se tem c\u0103 vor fi expuse unui risc de persecu\u021bie din cauza identit\u0103\u021bii pe care \u0219i-au format-o \u00een \u021a\u0103rile de Jos.<\/p>\n<p>Cererile ulterioare men\u021bionate au fost de asemenea respinse de autorit\u0103\u021bile neerlandeze, iar aceste tinere femei au sesizat instan\u021ba neerlandez\u0103 care a decis s\u0103 solicite Cur\u021bii de Justi\u021bie s\u0103 se pronun\u021be cu privire la interpretarea Directivei 2011\/95 privind protec\u021bia interna\u021bional\u0103, care stabile\u0219te condi\u021biile de acordare a statutului de refugiat de care pot beneficia resortisan\u021bii \u021b\u0103rilor ter\u021be.
